This is a condemnation suit in which the County of Sheridan sought to have condemned a parcel of land belonging to the defendant and containing gravel which the plaintiff desired to use in the construction of highways. The defendant obtained a judgment for $138.50 damages and $19.70 costs, the total amount of which was duly deposited with the clerk of court, and a final order of condemnation condemning approximately three acres of the defendants land was made. The defendant appeals from the judgment and from an order denying his motion for judgment notwithstanding the verdict or for a new trial.
